The incumbent serves as the technical expert for processing the following complaints which are not covered by the ORM:
Title IX complaints, prohibiting discrimination on the basis of sex in education programs or activities that receive Federal financial assistance. Title VI complaints under section 504 of the Rehabilitation Act of 1997, prohibiting discrimination on the basis of handicap in federally conducted programs or activities receiving financial assistance. Title VII complaints of the Civil Rights Act of 1964, prohibiting discrimination on the basis of race, color, or national origin, under any program or activity receiving Federal financial assistance from the Department of Veterans Affairs. Age Discrimination Act of 1975, prohibiting age discrimination to any program or activity receiving Federal financial assistance provided by the DVA directly or through another recipient. Other duties include but are not limited to:
Manages the Equal Employment Opportunity Program for the Director of TVAMC. Advises management of specific actions in support of affirmative actions, and strategies for handling discrimination complaints. Assists the Office of Resolution Management (ORM) and Administrative Judges with investigations and hearings. Provides documentation as requested; locate and identify employees involved in the complaint process; discuss resolution efforts, negotiate settlements, and draft same on behalf of management. Provides advice and assistance during the post-investigative stage for each formal complaint. Provides expert advice and primary staff support to top management in carrying out the continuing policy and program of nondiscrimination and affirmative action. Applies equal employment opportunity knowledge and skill sufficient to plan, direct, staff, carryout, and evaluate complaint counseling/investigation and hearings throughout all segments. Manages the Alternative Dispute Resolution Program, by using various procedures to resolve problems or cases without litigation to include but not limited to assisted settlement negotiations, conciliation, facilitation, mediation, fact-finding, mini-trials, and arbitration that require an impartial advisor or a neutral third party. Provides expertise and guidance as the facility's Alternate Dispute Resolution (ADR) Coordinator to promote principles and practices that will facilitate communication and improve working relationships; to establish the use of mediation as a problem solving process which is voluntary, confidential, mutually agreed upon and unbiased; to use the mediation process to allow parties to resolve their differences quickly, less formally and in a less adversarial manner. Conducts mandated New Employee Orientation on the Prevention of Workplace Harassment within 60-days of all newly hired employees' employment. Conducts studies and analyses on the employment of minorities and women, identifying obstacles and outlining alternative solutions to identified problems. Responsible for developing, implementing, coordinating, reviewing, monitoring, evaluating, and updating all plans associated with the EEO Program. Work Schedule:

Applicants who are current Federal employees and have held a GS grade any time in the past 52 weeks must also meet time-in-grade requirements by the closing date of this announcement. For a GS-12 position you must have served 52 weeks at the GS-11. The grade may have been in any occupation, but must have been held in the Federal service. An SF-50 that shows your time-in-grade eligibility must be submitted with your application materials. Experience:
You must have one year of specialized experience equivalent to at least the next lower grade GS 11 in the normal line of progression for the occupation in the organization. Examples of specialized experience would typically include, but are not limited to:
Managing command-wide programs such as the Affirmative Action Program, and all programs under the Special Emphasis Program. Counseling employees, former employees and applicants for employment who believe they have been discriminated. Counseling aggrieved persons about the EEO complaint process. Writing and preparing written counselor reports consulting with cognizant line officials, attorneys, union officials, and other HR employees to develop resolutions and disposition to EEO complaints. OR, There is no Education substitution for the GS 12 level. You will be rated on the following Competencies for this position:

Physical Requirements:
Regular and recurring work generally involves sitting at a desk, and sitting in conferences and meetings, except for occasional brief visits to worksites. Occasional use of automobiles may be required. No special physical exertion is required. The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
